Welcome to Misfit Boutique ("we," "our," or "us"). By accessing or using our website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website.

1. About Us

Misfit Boutique is an independent Canadian small business based in Ontario, Canada. We sell handmade jewelry, handmade crafts, and curated vintage and second-hand items. You can reach us at samantha@misfitboutique.ca.

2. Product Information

We describe every product as accurately as we can, including photographs, measurements, materials, and colours. Because of the nature of what we sell:

• Handmade items may contain small imperfections, uneven finishes, wire wrapping variations, and material inconsistencies that make each piece one of a kind. These are features of handmade craftsmanship, not defects. • Vintage and second-hand items are sold as-is. Due to their age, they may show wear consistent with previous ownership. Any significant flaws we are aware of will be disclosed in the product listing whenever possible. • Colours may appear differently depending on your screen.

3. Pricing

All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Prices may change without notice. Applicable taxes and shipping costs are calculated during checkout.

4. Orders

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order, in whole or in part, for reasons including but not limited to:

• Product unavailability or stock inaccuracies • Pricing or description errors • Suspected fraud or misuse of promotions • Payment authorization issues • Shipping restrictions

If payment has already been processed on a cancelled order, we will refund the amount paid in full.

5. Payment

Payments are processed securely through Stripe, our third-party payment processor. Card details are entered directly on Stripe's hosted checkout — Misfit Boutique does not receive, process, or store your full payment card details. 6. Order Acceptance & Confirmation

Order confirmation emails are automated and confirm that we have received your order. They do not constitute acceptance of your order. An order is considered accepted only once we have prepared it for fulfillment. If we cannot fulfill an order after payment has been processed, we will refund you in full.

7. Shipping

We ship from Ontario, Canada. Shipping times are estimates only. Once an order has been transferred to the shipping carrier, delivery times are outside our control. Customers are responsible for providing accurate shipping information. Additional shipping charges resulting from incorrect addresses may be the customer's responsibility.

8. Returns & Refunds

Please refer to our separate Refund & Return Policy for complete details. In summary:

• If an item arrives damaged due to shipping, please contact us within 7 days of delivery and include photographs of both the item and the packaging. • Vintage and one-of-a-kind items may be returned only if they arrive materially different from the listing description.

9. Intellectual Property

All photographs, product descriptions, logos, branding, graphics, and website content are the property of Misfit Boutique unless otherwise stated. They may not be copied, reproduced, distributed, or used in any commercial capacity without our prior written permission. Handmade designs are the original work of the maker and may not be replicated for resale.

10. Prohibited Use

You agree not to use this website for any unlawful purpose, and specifically not to:

• Attempt to interfere with the website's security, servers, or code • Use bots, scrapers, or automated tools to access, copy, or resell our content • Impersonate another person or misrepresent your identity • Submit false, misleading, or fraudulent orders • Post abusive, harassing, or infringing content • Circumvent pricing, discount codes, or purchase limits

11. Limitation of Liability

To the fullest extent permitted under the laws of Ontario and Canada, Misfit Boutique shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from the use of our website or products. Our total aggregate liability shall not exceed the amount paid for the specific product or service giving rise to the claim.

12. Jewelry Safety

Our jewelry may contain small components that could present a choking hazard. Please keep jewelry away from young children unless specifically designed for them. Customers with known metal sensitivities should carefully review the listed materials before purchasing.

13. Third-Party Services

Our website relies on trusted third-party providers, including Stripe (payments), Resend (transactional email), Etsy (product listings and inventory sync), and website analytics tools. Use of our website is also subject to these providers' respective terms and privacy policies.

14. Privacy

Your use of this website is also governed by our Privacy Policy, which forms part of these Terms.

15. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada. Any disputes arising under these Terms shall be resolved exclusively in the courts of Ontario, Canada.

We reserve the right to update these Terms & Conditions at any time. Changes become effective immediately upon publication on this website. We encourage you to review the Terms periodically for any updates.
